Processing of personal data in connection with the conclusion of a brokerage agreement:

  1. The Data Controller for your personal data is Tomasz Nowak conducting business under the name TOMASZ NOWAK NOWAK ESTATE with its registered office at Plac Wolnica 10/1, 31-060 Kraków, email: biuro@nestate.pl

– for the proper performance of the real estate brokerage agreement, based on Art. 6(1)(b) GDPR, and the data for this purpose will be processed for the duration of the agreement;

– for the establishment, exercise, or defense of legal claims – this is the implementation of the legitimate interests of the Data Controller, based on Art. 6(1)(f) GDPR, and the data for this purpose will be processed until the expiration of the statutory limitation periods for civil law claims (basic periods of 3 and 6 years from the due date of the claim - Art. 118 of the Civil Code, but the end of the limitation period falls on the last day of the calendar year unless the limitation period is shorter than two years);

– for tax settlement purposes, based on Art. 6(1)(c) GDPR, and the data for this purpose will be processed until the expiration of the Data Controller's tax obligations (basic period of 5 years, counting from the end of the calendar year in which the tax payment deadline expired - Art. 70 of the Tax Ordinance);

– to fulfill obligations under the Act on Counteracting Money Laundering and Financing of Terrorism, based on Art. 6(1)(c) GDPR, for 5 years, counting from the first day of the year following the year in which economic relations with the client were terminated or occasional transactions were carried out - Art. 49 of the Act on Counteracting Money Laundering and Financing of Terrorism;

– if you additionally gave consent when signing the agreement (e.g., for processing for marketing purposes, contact with a credit advisor, etc.), the data will be processed based on Art. 6(1)(a) GDPR, until you withdraw your consent.

Recipients of your personal data will be employees (collaborators) of the data controller, entities to whom the data controller has entrusted data processing (CRM software providers, hosting providers, accounting office), other brokers cooperating within the MLS.org.pl system, notaries, credit advisors, legal advisors providing legal services to the data controller;

  3. You have the right to: request access to personal data from the data controller, the right to rectify, delete, or limit processing, the right to object to processing, the right to data portability, the right to withdraw consent at any time;

  5. Providing personal data is a statutory requirement and a condition for entering into an agreement, and failure to provide data to the extent required by the data controller may result in refusal to enter into an agreement; for processing based on consent – providing data is voluntary;

Processing of personal data in connection with the presentation of real estate without entering into a brokerage agreement:

  3. – for the presentation of real estate offered for sale/rent based on Art. 6(1)(f) GDPR. This processing is necessary for the purposes arising from the legitimate interests pursued by the controller (proper execution of the brokerage agreement with the Seller/Landlord) and the legitimate interests pursued by the third party, i.e., the Seller/Landlord (ensuring the security of assets and presenting real estate only to verified viewers);
  4. – for the establishment, exercise, or defense of legal claims – this is the implementation of the legitimate interests of the Data Controller, based on Art. 6(1)(f) GDPR, and the data for this purpose will be processed until the expiration of the statutory limitation periods for civil law claims (basic periods of 3 and 6 years from the due date of the claim - Art. 118 of the Civil Code, but the end of the limitation period falls on the last day of the calendar year unless the limitation period is shorter than two years);
